Our firm attorney demonstrated recently that you can succeed in Louisiana on summary judgment. Plaintiff sued the landlord after being mauled by the tenant’s dog. Absent proof of knowledge of the dog’s dangerous propensities, and the ability to control the dog, Plaintiff lacked evidence necessary to sustain her burden of proof. This was the ruling of District Court Judge, Allen Parker Self, affirmed by the Second Circuit. The unanimous panel included: Williams, Drew, and Garrett JJ.
