On March 22, 2012, following a four day jury trial, B&T attorneys Andre Gaudin and Richard Pavlick received a unanimous defense verdict in Kathleen Hill Tilden and James Tilden v. Blanca, L.L.C., et al. The plaintiff, a patron at defendant’s restaurant, was injured when she fell walking through the dining room. The plaintiff alleged the floors of the restaurant were sweating and posed a danger to patrons. She claimed she suffered a herniated disc in her neck, rotator cuff tears in both shoulders that required surgery, and depression. Plaintiff incurred medical bills of $180,000, lost wages of $110,000, and asked for a total of $1.1 million dollars in closing argument.
The four day trial was held in the plaintiff friendly venue of New Orleans Civil District Court. The jury returned a unanimous defense verdict in fifteen minutes finding that no condition existed at the restaurant causing plaintiff to fall.
